By creating an account, accessing, or using Ariex, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and mobile application. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.

2. Eligibility

You must be at least 17 years old to use our Services. By using Ariex, you represent and warrant that you meet this age requirement.

If you are under 18 years old (or the age of majority in your jurisdiction), you represent that you have obtained permission from your parent or legal guardian to use the Services, and they have agreed to these Terms on your behalf.

3. User Accounts

Account Creation

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Not share your account with others
• Log out of your account at the end of each session on shared devices

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Use of Services

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial use.

Acceptable Use

You agree not to:

• Use the Services for any illegal purpose or in violation of any local, state, national, or international law
• Violate, or encourage others to violate, any rights of third parties
• Post, upload, or distribute any content that is unlawful, defamatory, libelous, inaccurate, or that a reasonable person could deem to be objectionable, profane, indecent, pornographic, harassing, threatening, hateful, or otherwise inappropriate
• Interfere with security-related features of the Services
• Interfere with the operation or any user's enjoyment of the Services, including by uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code
• Attempt to gain unauthorized access to the Services, user accounts, or computer systems or networks
• Use any automated system or software to extract data from the Services (scraping)
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Use the Services to send spam, chain letters, or other unsolicited communications
• Reverse engineer, decompile, or disassemble any portion of the Services
• Copy, modify, create derivative works of, or redistribute any part of the Services

5. Medical Disclaimer and Assumption of Risk

Consult a Healthcare Professional

Before beginning any exercise program, you should consult with your physician or other healthcare provider. This is especially important if you:

• Have any pre-existing medical conditions
• Are taking any medications
• Are pregnant or nursing
• Have a history of heart disease or other cardiovascular conditions
• Experience pain, dizziness, or shortness of breath during exercise

Assumption of Risk

You acknowledge and agree that physical exercise involves inherent risks of injury. By using our Services, you voluntarily assume all risks associated with physical activity, including but not limited to:

• Muscle strains, sprains, and tears
• Bone fractures and joint injuries
• Cardiovascular complications
• Other injuries or health complications

No Medical Advice

Our AI-generated training plans and any content provided through the Services are for informational and educational purposes only. They do not constitute medical advice and should not be relied upon as a substitute for professional medical consultation, diagnosis, or treatment. Always seek the advice of your physician or qualified healthcare provider with any questions you may have regarding your health or a medical condition.

6. User Content

Your Content

You retain ownership of any content you submit, post, or display through the Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating and providing the Services.

Responsibility for User Content

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the necessary rights to submit your User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with these Terms and applicable laws

Content Removal

We reserve the right (but have no obligation) to remove, modify, or reject any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

7. Intellectual Property Rights

The Services and all content, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, selection, and arrangement) are owned by Ariex, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Services, nor may you reverse engineer or attempt to extract the source code of our software, unless laws prohibit these restrictions or you have our written permission.

8. Subscriptions and Payments

Free and Pro Tiers

Ariex offers two service tiers:

• Free: Up to 3 training plans, 15 exercises per plan, 1 AI plan generation, 5 custom exercises, and 30 days of workout history.
• Pro ($3.99/month): Unlimited training plans, exercises per plan, AI plan generations, and custom exercises. Unlimited workout history, body metrics charts, data export, and advanced analytics.

Feature limits and pricing are subject to change. Current details are always displayed in the app before you subscribe.

Payment and Billing

Ariex Pro subscriptions are billed monthly through Apple's App Store. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Free Trials

We may offer free trial periods for Ariex Pro. If you do not cancel before the trial ends, your subscription will automatically convert to a paid monthly subscription at the displayed price.

Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation will take effect at the end of your current billing period, and you will retain access to Pro features until then. Refunds are handled by Apple in accordance with their refund policies.

Price Changes

We reserve the right to change our subscription prices at any time. Apple will notify you of any price changes in advance. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

9. Third-Party Services and Links

Our Services may contain links to third-party websites or services that are not owned or controlled by Ariex. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Ariex shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIEX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers and/or any personal information
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Services
• User Content or the defamatory, offensive, or illegal conduct of any third party
• Any injuries, health complications, or damages resulting from your use of training plans or exercise programs

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ariex, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content
• Your exercise activities or any injuries resulting from such activities

13. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to your breach of these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may do so by deleting your account through the app settings or contacting us.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts of Poland, and you consent to personal jurisdiction in such courts.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the Services.
